I was denied a clearance by the intelligence community in 2002 for past homosexual activity-activity occurred in late 1998 and did not include illegal behavior. I appealed and won a reversal of their decision and was allowed to reapply. I was once again offered a job but turned it down to work for a DoD agency outside the intel community.
I did make the mistake of sharing the paperwork explaining the reasons for my denial in 02 with adjudicators at DOD because at the time, 2002, I also had a job opportunity with them and wanted to be up front about this issue. They didn’t withdraw their offer, deciding instead to wait for the results of my appeal to the IC’s denial. This latter DOD offer differs from the agency I currently work for.
The DOD agency that offered me a job at the same time as the IC in 02 used the latters denial to issue me a Letter of Intent to deny me a clearance in late 2004. This was remarkable to me because by the time they issued this I had already appealed and won a reversal of the original denial and had received a new offer from them. In effect I was being tried a second time.
As I mentioned, I now work for a different DOD agency because I withdrew from consideration from the first DoD job offer. I did make the mistake of sharing my paperwork he DoD adjudicators actually advised me to do this. They told me withdraw from the first position and accept the second. This would require a new investigation which would allow me to begin work with an interim clearance.
That was 2005 and I still have an interim clearance. It’s amazing to me, the original reason for denying me a clearance was overturned but because I shared this info with DOD-of my own volition in order to be cooperative with DoD’s investigation-I am now stuck in perpetual limbo with interim TS.
I am certain that if this matter pertained to anything beyond homosexual activity, activity that was not illegal or indicative of a personality disorder, that I’d be cleared by now. Instead I am probably stuck in perpetuity with an interim clearance and thus unable to move within the civil service. It seems to me this regulation will only make it easier to repeat this behavior with others.
